I-130 Petition filing on Behalf of a Spouse, Minor Child, or Parent of a U.S. Citizen.

WHERE TO FILE THE PETITION (FORM I-130)

The American Embassy in Copenhagen accepts I-130 petitions filed on behalf of an immediate relative (spouse, minor child, or parent) by an American Citizen only, provided that:



  • The American citizen has been continuously, legally resident in Denmark for at least six months prior to petition filing.



     

American citizens, who are in Denmark on a temporary status, such as student or tourist status, do not meet the residency requirements and may not file a petition in Copenhagen.

All legal permanent residents of the U.S. ("Green Card" holders) and American citizens resident in the United States (or with a permanent address in the United States) will file I-130 petitions at the USCIS service center in the United States having jurisdiction over their place of residence.  A list of service centers is included in the instructions with the downloadable form I-130.  For further information please consult the USCIS website: www.uscis.gov
